Liberal Professions That Need a Business Permit in Luxembourg

In Luxembourg, certain liberal professions require a business permit (autorisation d'etablissement) AND a recognised diploma in the field. These are regulated professions — you cannot just declare yourself an architect or accountant without proving your qualifications.

What is a "liberal profession"?


A liberal profession is an intellectual, regulated activity that is not commercial, artisanal, or industrial. Common features:


  • You sell expertise, not goods
  • The activity is regulated (a diploma is required by law)
  • There is usually a professional body (ordre or chambre)
  • You are personally responsible for your work


If your activity is intellectual but not regulated by a specific diploma requirement (for example IT consulting, marketing consulting, translation), it is generally classified as commercial, not liberal. We covered this in our article on IT consultants: commercial or liberal?


Architects, engineers, accountants — the regulated diploma route


For these professions, you need:


  • A specific diploma recognised by the Ministry of Economy
  • A business permit (autorisation d'etablissement) — same 4 criteria as any business: integrity, qualification, fixed premises, effective management
  • Registration with the relevant professional body (OAI for architects and engineering consultants, OEC for chartered accountants)


Practical tip: Foreign diplomas must be recognised before you apply for the business permit. The recognition is done by the Ministere de la Recherche et de l'Enseignement superieur (MESR) at mesr.gouvernement.lu. Start this process early — it can take weeks.


Liberal professions outside the business permit system


Some liberal professions are regulated under their own laws — they do NOT go through the standard business permit process:

What if your activity is not on these lists?


If your intellectual activity is not on the regulated list:


  • You probably do not need a specific diploma
  • You still need a business permit (general criteria apply)
  • You are likely classified as a commercial activity, not a liberal profession

Foreign diplomas — recognition process


Before applying for the business permit:


  1. Submit your diploma to MESR for recognition: mesr.gouvernement.lu — administrative fee 75 EUR
  2. For EU diplomas, mutual recognition rules often apply (faster process)
  3. For non-EU diplomas, the Ministry assesses equivalence — may require additional training or proof of experience
  4. Once recognised, attach the recognition decision to your business permit application


A non-recognised diploma will block your business permit application. Do not assume your foreign diploma is automatically valid in Luxembourg — even within the EU, recognition is a formal step.
